These terms apply when you use Albumo, whether you are hosting an event album or contributing photos to one as a guest.

Agreement to these terms

Albumo is operated by [Company Legal Name] (“Albumo”, “we”, “us”). By creating an album, scanning an album QR code, uploading a photo, or otherwise using the service, you agree to these terms. If you do not agree, please do not use Albumo.

What Albumo does

Albumo lets an event host create a shared photo album and invite guests to contribute to it by scanning a QR code. Guests can upload photos from a browser without installing an app or creating an account. We may add, change, or remove features over time.

Eligibility

You must be at least [age] years old to host an album or contribute to one. If you use Albumo on behalf of an organisation, you confirm that you are authorised to accept these terms for it.

Host responsibilities

If you create an event album, you are responsible for:

  • Sharing the album code or link only with people you intend to give access to.
  • Telling your guests that photos they upload will be visible to others with album access, and obtaining any consent required for photographs taken at your event.
  • Moderating your album and removing content that should not be there.
  • Complying with any venue rules and applicable privacy or image-rights laws.

Your content

You keep ownership of the photos and other content you upload. By uploading, you grant Albumo a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content solely to operate and provide the service — for example, to show it in the album, create thumbnails, and let the host download it. This licence ends when the content is deleted, apart from copies retained in backups for a limited period.

You confirm that you have the rights needed to upload the content and that it does not infringe anyone else’s rights.

Acceptable use

You agree not to:

  • Upload content that is unlawful, abusive, harassing, hateful, or sexually explicit.
  • Upload images of people who have asked not to be photographed, or where doing so is unlawful.
  • Infringe intellectual property, privacy, or publicity rights.
  • Upload malware, attempt to breach security, or disrupt or overload the service.
  • Access albums you have not been invited to, or scrape or bulk-download content.
  • Use Albumo to send spam or for any unlawful purpose.

Content removal and suspension

We may remove content or suspend access to an album or account that we reasonably believe breaches these terms or the law, or that presents a risk to other users. Where practical, we will let the host know.

Service availability

We aim to keep Albumo available and reliable, but we do not guarantee uninterrupted access. Maintenance, updates, or issues outside our control may cause downtime. Albumo is not a backup service — please keep your own copies of photos that matter to you.

Paid plans

Where a plan is paid, the applicable fees, billing period, and refund terms will be presented before purchase. Fees are exclusive of taxes unless stated otherwise, and paid features are available for the period you have paid for.

Disclaimers

To the extent permitted by law, Albumo is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that content will always be preserved.

Limitation of liability

To the extent permitted by law, Albumo will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, photos, profits, or goodwill. Our total liability arising out of or relating to the service is limited to the greater of the amount you paid us in the [12] months before the claim, or [amount]. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You agree to indemnify and hold Albumo harmless from claims, losses, and expenses arising from content you upload, your use of the service, or your breach of these terms or of another person’s rights.

Termination

You may stop using Albumo and delete your albums at any time. We may suspend or terminate access if you breach these terms, or if we discontinue the service. Provisions that by their nature should survive termination will do so.

Governing law

These terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] will have exclusive jurisdiction over any dispute, except where mandatory local law gives you the right to bring proceedings elsewhere.

Changes to these terms

We may update these terms as the service develops. If changes are material, we will give notice through the service or by email. Continuing to use Albumo after changes take effect means you accept the revised terms.
